Imagen Therapeutics takes its responsibility to protect your personal data seriously. We respect your privacy and your rights to control your personal data and want to be clear about the data we collect and why.

In light of the new legislation on data protection, the GDPR (General Data Protection Regulation), which came into force 25th May 2018, Imagen Therapeutics revised its Privacy Notice in order to comply with the new requirements.

This is our Privacy Notice and it explains how we collect, use, share and protect your personal data.

We are responsible for the collection and proper management of any personal or sensitive information we hold. We will keep your personal data secure and use the information you provide consistently with regard to the GDPR (General Data Protection Regulation) 25th May 2018.

2. What information do we collect?

In order to use our service, we need to collect from you the following information:

  • Your name
  • Your gender
  • Your date of birth
  • Contact telephone number
  • Email address
  • Your residential address
  • Your bank details
  • Certain medical details regarding your type of cancer and relevant medical history

3. How do we use your information?

We will use your personal information:

  • To communicate with you in connection with the service
  • For the performance of the services
  • In the performance of our internal quality assurance activities
  • For collecting payment of the service fee from you
  • In complying with our legal obligations

In addition to the personal information we hold about you, we will also maintain a separate database of anonymised health information. This information includes your medical history, your response to certain treatments and/or how certain drugs responded in your predictRx test. Being anonymised means we have separated the information that identifies you (“Identifiers”) as an individual from this personal information.

The “identifiers” are maintained in a separate limited access database and will not be combined except in the event that:

  • We are required to do so to comply with any regulatory requirements or applicable laws


  • We are required to make such combination as a result of an order of court

We may use your anonymised data to:

Perform research to gather more information on how well the predictRx test works and the impact it has on patients who have undergone the predictRx test. Also, to improve the testing process.  Any publications relating to these studies will be based on anonymised data and you will not be able to be personally identified.

4. On what legal basis will we process your information?

We will always process your personal information on lawful grounds and in particular on the grounds set out below:-

Performance of a Contract

If you use our service we will always provide you with full details of the process, including what personal information we need to collect from you and how it will be used, stored and for how long it will be kept.

The contract will be signed both by yourselves and a representative of Imagen Therapeutics.


We will obtain your freely given consent to us to perform our services and to hold and process your personal data as stated above. We will provide you with a consent document containing all the necessary information which will be signed both by yourselves and a representative of Imagen Therapeutics.

By signing the contract and consent you are agreeing to the terms and conditions of our service and the processing of your personal data. In respect of GDPR you the patient will be deemed the “data controller” of your data and Imagen Therapeutics the “data processor”.

You can withdraw your consent at any time.

5. Who will you share my information with?

We may share your anonymised information with contracted personnel for the purposes of statistical analysis of the data or for reporting purposes.

We will only give your personal information to third parties where the law either requires or allows us to do so.

6. How do you store and manage my information?

We store your personal information within our secure limited access database which is maintained by a third-party IT systems provider and with whom we have a data processing agreement (DPA). The DPA legally bind the provider to comply with the GDPR.

7. Updating Your Details?

If you would like to amend your personal information you can do so by contacting Imagen Therapeutics using the details in section 1 above.

8. How long will we hold your information for?

We have a system of retention periods in place to ensure that your information is only stored whilst it is required for the relevant purposes or to meet legal requirements. Where your information is no longer required, we will ensure it is disposed of or deleted in a secure manner.

9. Your rights

You have the right to ask us at any time: –

  • to confirm whether we hold any of your personal data
  • to send you a copy of any personal data that we hold about you
  • to correct any inaccuracies in your personal data and to add relevant details where the personal data we hold is incomplete
  • to delete (to the extent possible) any of your personal data, where we are required by law to do so
  • to stop processing your personal data, where we are required by law to do so
  • to let you have a portable copy of the personal data we hold about you, where we are required by law to do so
  • to stop processing any of your personal data that we process on the basis of our legitimate interests; and

Where we process your personal data on the basis that you have given us your consent to do so then you may contact us at any time to withdraw your consent.
